Update - September 17, 2009

On September 17, 2009, Justice Pepall from the Ontario Superior Court of Justice, Commercial Court, issued an endorsement regarding the legal representation of current and former employees of Fraser Papers.  Link to the full copy of the Fraser Papers Endorsement.


Update - August 20, 2009

We have sought and obtained a date for the representation motion to be heard by the Commercial Court. The motion will be held on September 8, 2009 in Toronto. During this motion, we will seek an order from the Court authorizing us and Shibley Righton to represent the FPSRC in the CCAA proceedings and to recover the costs of such representation from Fraser Papers.  Furthermore, we intend to seek an additionnal order to extend the claims bar date past September 30, 2009. Should the Court refuse the representation order, it is very likely that it will grant a similar order to a law firm chosen by Fraser Papers to represent the retirees and employees of Fraser Papers in these proceedings.

We understand that the Monitor has recently sent Proof of Claims Packages to potential claimants. It should be noted that it is not necessary for salaried retirees to complete these forms by themselves as it is almost certain that this group will be represented in these proceedings, either by Nelligan O’Brien Payne or by the law firm selected and proposed by Fraser Papers. Should we be appointed as representative counsel,  we will communicate with retirees and assist with any proof of claims that have to be filed.

As this matter progresses, we will update our website with any new information that is available.

We believe that it will be persuasive to the Court if we are able to demonstrate that a large number of retirees have retained us. Your involvement at this time is therefore important, particularly as the deadline for creditors to file claims against Fraser Papers is September 30, 2009. We will not ask group members for any retainer beyond their initial deposits of $150 in support of our application for this Order.

Update - July 24, 2009

On July 23, 2009, lawyers from Nelligan O'Brien Payne and the Steering Committee of the Fraser Papers Salaried Retirees Committee (FPSRC) held an information session for former Salaried (non-union) retirees of Fraser Paper Inc. regarding Fraser Papers recent filing for protection under the Companies Creditors Arrangement Act (CCAA).

The Fraser Papers Salaried Retirees Committee (FPSRC) has retained Nelligan O'Brien Payne LLP on behalf of itself and the members of the Group it represents for advice and representation in connection with the legal proceedings presently brought by Fraser Papers under the Companies' Creditors Arrangement Act ("the CCAA Proceedings"), subject to the signing of retainers by the Group members. Our instructions are to apply, when we deem it appropriate to do so, to the Commercial Court for an Order authorizing us to represent the FPSRC in the Court proceedings and to attempt to recover the costs of such representation from Fraser Paper.
