Helpful Tips to Prepare for Your First Contact with Us
In order to conduct a patentability search or to prepare an application for patent in Canada, or to assist with the preparation of a trade-mark application to register a trade-mark in Canada, we respectfully ask you to provide us with the following information:
Patents
- Describe the general nature of the proposed invention
- Provide a thorough description of the existing technologies relating to the proposed invention. If it is known to the inventor(s), details of all relevant patents, scientific literatures and other published materials
- List the shortcomings of these existing technologies and discuss how the proposed invention provides an advantage or advantages over these technologies in solving the problems faced by the industry or consumer market
- State the objectives of the proposed invention
- State the inventive or novel features of the proposed invention
- Describe in detail how the proposed invention works. If there is a preferred way of carrying out the invention, e.g., to carry out a manufacturing process within a specific temperature range or to adopt two elements together at a particular angle, such preferred way should be clearly described
- Include all relevant drawings, tables, graphs, flowcharts and/or block diagrams in suport of and to illustrate the proposed invention
- Confirm whether any publication or disclosure has been made and, if yes, details of such publication or disclosure
Trademarks
- Provide the trade-mark itself. If it is a word or phrase, please clearly spell out the word or the phrase. If it is a word or phrase in a particular script/font or if it is a design/logo, then the image of same. Please also state whether colour forms part of the trade-mark
- A list of wares (goods or products) and services, if applicable, described in ordinary commercial terms to be used in Canada under the trade-mark
- Since an applicant can apply for trade-mark registration based on either prior use of the mark in Canada or intent to use the mark, we will require information on the date of first use of the trade-mark, if it has been so used commercially in Canada
- If foreign trade-mark registrations have been secured or application filed for the same trade-mark, details of such registrations or applications information
- The legal name and postal address of the individual applicant or corporate applicant
