Bankruptcy, Insolvency and Workouts
- Acted for a large financial institution in realizing the sale of Hart Brewery as a going concern with full recovery of all loans and legal fees.
- Successfully represented a large financial institution in bankruptcy proceedings resulting in it being declared a secured creditor and another bank being declared an unsecured rather than a secured creditor.
- Acted for the a large financial institution for the voluntary receivership of a supply business in the Kingston area.
- Acted as counsel on behalf of a court appointed Liquidator and responsible for the winding up of a large land-holding and management company that was forced into liquidation.
- Involved in the settlement with the Trustee for a retail business where the minority shareholders purchased the bankrupt's 51% share of the company.
- Handling the workout for insurer of large insured loan on multi-residential apartment building.
- Provided legal services for the Trustee in Bankruptcy for the sale of a large local equipment rental firm.
- Assisted secured creditor in the sale of a large material supply firm in Kingston.
- For many years we have provided ongoing legal services in major mortgage recovery work for large financial institutions in Eastern Ontario - commercial and residential workouts, foreclosures and powers of sale.
- Provided legal services to a local collections agency involving garnishments, writs of seizure and sale judgement debtor examinations and enforcement proceedings.
- Retained by the Oxford (Massachusetts) based subsidiary of a large U.S. Company which is a creditor in a bankruptcy proposal involving a local company.
Lending Transactions
- Acted as counsel for a large financial institution in relation to the financing for the newly launched Aboriginal Peoples Television Network (APTN), including registration of security in various provinces.
- Acted for financial institution in lending transactions requiring registration of security interests in various provinces and territories.
- Handling commercial mortgages for large institutional financial lenders.
- Handling the acquisition financing for a major retail land development.
- Negotiating land acquisition, development and financing in relation to a $5 million development of a residential care facility.
