Tainted Salad Class Action Information Page
This information is intended for people who became ill upon eating Greek-style pasta salad manufactured by Tiffany Gate Foods Limited, which may have been purchased at a Loblaws Supermarket, Your Independent Grocer store, LOEB, or other grocery store in the province of Ontario. The information is also intended for members of their respective families.
Settlement Approved
The firms of Nelligan O'Brien Payne and McPhadden Samac Merner Barry are pleased to announce that a settlement agreement has been executed by class counsel and has been presented to the court for its approval. THE AGREEMENT WAS APPROVED BY THE COURT ON JULY 22, 2008.
If the Class Member has PREVIOUSLY PROVIDED HIS OR HER CLAIM INFORMATION TO CLASS COUNSEL, he or she does not have to fill out this claim form (Form 1) but, the CLAIMANT MUST STILL FILL OUT THE CONTACT INFORMATION UPDATE FORM (Form 2), and mail it to the Claims Administrator.
If a Class Member who is seeking settlement benefits under the Settlement Agreement HAS NOT PROVIDED INFORMATION TO CLASS COUNSEL with respect to his or her claim, this claim form (Form 1) must be filled out in its entirety and mailed along with all required documents to the Claims Administrator.
The amount of compensation available to each claimant will vary depending primarily on the length of illness. The settlement figures arrived at represent compromise and were based on a range of damage figures assessed by various courts over the last few years and set out in reported decisions.
